Purchase Policy

ELEMENT4779 Purchase Policy

1. Display of Cart Total

Before you complete a purchase, your cart will display:

  • The items selected
  • The current offered price for each item (based on then-current gold and/or silver market pricing used by the Site)
  • Applicable taxes, shipping, insurance, and any other disclosed fees
  • The Cart Total

The Cart Total shown before the credit card hold is an offered price only. It is not locked until the 10% credit card hold described below is successfully placed.

2. Required 10% Credit Card Hold

To proceed, you must authorize a credit card hold equal to ten percent (10%) of the Cart Total (the “Hold”).

The Hold:

  • Is placed on a valid credit card in your name
  • Is calculated on the full Cart Total displayed at the time of authorization
  • Must be successfully authorized before any price lock or purchase confirmation takes effect

If the Hold is declined, expires, or cannot be placed for any reason, the order will not be confirmed and the price will not be locked. If the Hold is reversed at any time prior to completed payment, the customer will be legally obligated to pay back the 10% Hold.

The Hold is not the final payment. It is a deposit/authorization that confirms your intent to purchase the items in your cart at the locked price and starts the completion window described below.

3. Price Lock and Purchase Confirmation

Once the 10% Hold is successfully placed:

  1. Your purchase price is locked at the Cart Total based on the gold and silver market pricing then used by the Site.
  2. That locked Cart Total will apply to the items in that cart for the duration of the completion window, even if market prices later rise or fall.
  3. The Hold confirms that you are purchasing the items then in your cart and that you agree to complete payment of the locked Cart Total.
  4. A forty-eight (48) hour completion clock begins (the “Completion Window”).

The price lock applies only to the specific items, quantities, and Cart Total associated with that Hold. Once the Hold is completed, the customer will not be able to add, remove, or change items.

4. Forty-Eight (48) Hour Completion Window

You must complete final payment of the locked Cart Total so that good funds are initiated in accordance with the payment methods below within forty-eight (48) hours of the successful Hold (or such other time as the Site may display at checkout).

The Site may specify whether the 48 hours are calendar hours or exclude weekends/bank holidays. If not otherwise stated at checkout, the 48-hour period is consecutive calendar hours from the time the Hold is confirmed.

If you do not complete the required final-payment steps within the Completion Window, the Site will cancel the order and the Hold is forfeited as set forth in Section 7.

5. Final Payment Methods

After the Hold is placed and the price is locked, the total balance of the Cart (and, as applicable, the full Cart Total subject to release of the Hold) must be paid by one of the following:

  • Electronic check (eCheck)
  • ACH transfer
  • Wire transfer

Credit cards are used only for the 10% Hold and are not accepted as the method to pay the remaining Cart Total, unless the Site expressly states otherwise in writing at checkout.

You are responsible for:

  • Sending payment for the correct locked amount
  • Including any required order/reference number
  • Paying any bank, wire, or intermediary fees so that the Site receives the full amount due
  • Allowing sufficient time for the payment to be initiated within the Completion Window

6. When Funds Clear; Release of the Credit Card Hold

The order is not fully funded until cleared, collected funds appear in the Site’s designated account (“Good Funds”).

  • ACH and eCheck payments are not Good Funds until they have cleared and are not subject to return or reversal.
  • Wires are not Good Funds until received and identified as matching your order.

After Good Funds for the Cart Total are received, the Site will release or refund the 10% credit card Hold. Timing of the release on your statement depends on your card issuer and may take several business days after the Site initiates the release.

Until Good Funds are received, the Site has no obligation to ship, allocate inventory beyond the lock terms, or treat the order as paid in full.

7. Forfeiture of the 10% Hold

If, after the Hold is placed:

  • You fail to complete eCheck, ACH, or wire payment as required;
  • Payment is not initiated within the Completion Window;
  • Payment is returned, reversed, rejected, insufficient, or otherwise does not result in Good Funds in the Site’s account; or
  • You cancel, abandon, or refuse to complete the confirmed purchase,

the 10% Hold will be forfeited by you and may be captured by the Site as liquidated damages and/or a non-refundable deposit.

You acknowledge that precious metals prices are volatile, that the Site locks price and may reserve or hedge inventory based on your confirmed order, and that the forfeited amount is a reasonable pre-estimate of loss and administrative cost—not a penalty.

The Site may also cancel the order, decline future orders, and pursue any unpaid balance or additional damages if actual loss exceeds the forfeited Hold.

8. Failed, Returned, or Incomplete Payments

If an eCheck or ACH is returned (including NSF, stop payment, account closed, or similar):

  • The price lock may be voided
  • The 10% Hold may be forfeited
  • You may be charged any return/NSF fees permitted by law
  • Any new order will be at then-current market pricing and will require a new Hold

The Site is not responsible for delays caused by your bank, incorrect account details, missing wire references, or intermediary banks.

9. Chargebacks and Disputes on the Hold

Initiating a chargeback, dispute, or unauthorized reversal of the Hold after you have confirmed the purchase may be treated as a failure to complete the transaction. The Site may submit proof of this Policy, your authorization, the price lock, and related records to the card network and may pursue recovery of the forfeited amount and any additional losses.

10. Identity, Compliance, and Right to Decline

The Site may require identity verification, payment-source verification, or other information before accepting a Hold, locking a price, or releasing metals. The Site may refuse, delay, or cancel an order if it reasonably believes the transaction is fraudulent, incomplete, legally restricted, or inconsistent with this Policy.

11. Shipping After Good Funds

Metals will be prepared and shipped only after Good Funds are received and any required verification is complete. Shipping timeframes begin after funding and verification—not at the moment the Hold is placed.

12. Summary of the Process

  1. Review your Cart Total.
  2. Authorize a 10% credit card Hold on that total.
  3. Price is locked to the current gold/silver-based Cart Total; a 48-hour completion clock starts; your intent to purchase is confirmed.
  4. Pay the Cart Total by eCheck, ACH, or wire.
  5. When Good Funds appear in the Site’s account, the Hold is refunded/released.
  6. If Good Funds do not arrive as required after the Hold, the 10% is forfeited.

13. Changes and Contact

The Site may update this Policy. The version presented at the time you authorize the Hold applies to that order.

For questions about a Hold, payment instructions, or whether funds have been received, contact [email protected] and include your order number.
